After the long struggle, finally, on 26th July 2021, the Hon’ble High Court of Telangana passed an interim order on the writ petition that was filed by IndusViva Healthsciences Pvt. Ltd., directing to de-freeze all the bank accounts and not interfere with the organization’s day-to-day operations. Moreover, the court had set aside an impugned Preventive Detention order on the key people of the company on 27th September 2021.

Who are IndusViva, and what do they do?

IndusViva is a Direct Selling company that started its journey in 2014 with only 1 product. In 2021, they are the proud owner of 5 world-class ayurvedic health promoter products manufactured under the licence of the Department of Ayush. IndusViva is a company that rose to its feet when the whole world, including the Direct Selling industry, was entirely under lockdown due to the deadly pandemic. After the 1st phase, they completely digitalized their business strategy from physical to virtual; empowered the distributors by training them with several digital tools through virtual meetings. Even though they have faced extensive damage, they still managed to have nearly the same turnover as the previous year. They had a total turnover of approximately INR 1450 crores in 7 years, out of which nearly half was paid to the direct sellers as commission for selling the products and almost 200 crores to the Central and State Govt. as various taxes like GST, Income Tax, TDS etc. They sell their products through a direct selling/multi-level marketing model, a legitimate economic activity per Consumer Protection Act 2019, and Govt. of India-issued Direct Selling Guidelines, 2016. The Government is on the verge of issuing Consumer Protection (Direct Selling) Rules, 2021. Though the Govt. of India and NITI Aayog publicly stated multiple times that the Direct Selling industry is a scope for the coming days and this industry can accommodate the opportunity-seeking youth of the country, but the steps initiated by them till now are not enough to protect the interest of the young job aspirants and the companies who are ready to provide the opportunities. Due to the lack of such clarity and proper education on the part of the law enforcement agencies, the future of the young aspirants and the companies are in darkness.
